On Tuesday, the National Prosecuting Authority released a partial report on its audit of cases during the United Right-wing government from 2016 to 2023. The document was prepared by a team of 10 prosecutors tasked with investigating: If an investigation is started or stopped for political reasons.
The report covered 200 of the 600 cases investigated and found significant fraud in 163 cases, team members said.
Kwiatkowska: 50-60 prosecutors will be subject to disciplinary proceedings
Prosecutor Katarzyna Kwiatkowska was asked on Tok Fm radio on Wednesday how many prosecutors had acted contrary to the law and procedure.
– Of the 149 criminal cases we investigated, three prosecutors actually resisted their superiors and tried to follow the letter of the law and case law. (…). On the other side are all the remaining prosecutors, some of whom are repeating the same thing. Therefore, approximately 50 to 60 prosecutors will be involved in these criminal or disciplinary cases, Kwiatkowska said.
He added that the principle of presumption of innocence also applies to reference prosecutors against whom criminal proceedings are instituted. He stressed that the prosecutor can only be suspended by initiating proceedings based on the audit.
According to Kwiatkowska, this means that some of the group of 50 to 60 prosecutors will continue to work as usual. “There is no possibility of removing the prosecutor from the performance of his official duties without any formal or criminal procedure,” she stressed.

Procedure Kwiatkowska added that work has already begun on the next part of the report, which will cover 400 minutes, some of which will span between 300 and 400 volumes. She did not want to declare a completion date for the work. She agreed with the statement that the official deadline for the prosecution team’s work, which was until the end of February, could be extended.
Last summer, the National Prosecuting Authority announced the establishment of a prosecution team “to investigate cases of public interest due to their subject matter and the nature of the cases carried out and completed between 2016 and 2023.” The team was established following the order of State Prosecutor Dariusz Kornerk on August 16 last year. A full final report on the team’s work, covering all matters investigated, is expected in February 2025.
