From January, it will be possible to send registered letters to many offices and institutions through the Internet. The electronic delivery system will be launched. The service will be free. – A document sent using electronic transmission is legally equivalent to traditional registered mail with confirmation of receipt – explains Dariusz Standerski, Deputy Minister of Digitization.
The electronic delivery system will be widely launched at the beginning of January next year. This is why most offices should enable electronic correspondence. Thanks to this, citizens can send and receive letters in this form.
– A document sent using electronic transmission is legally equivalent to traditional registered mail with acknowledgment of receipt, and the number of entities that must use this form of correspondence is constantly increasing – explains Dariusz Standerski, Deputy Minister of Digital.
The operation of the new system is regulated by the Law on electronic transmission.
The service is completely free
The popularization of electronic transmission in practice means that all official letters and decisions can be received and sent electronically. This solution makes it easier for both Kowalski, entrepreneurs and officials to solve administrative problems.
It is important that citizens can use the service completely free of charge in relation to government bodies, so it saves not only a lot of time, but also money, compared to traditional document delivery. In order to use this tool freely, it is necessary to submit an application for the creation of an electronic transfer box today – it can be done in a few simple steps on the website mObywatel.gov.pl.
Who should have an electronic delivery address?
The electronic transmission box must be accessible to: entrepreneurs registered in the CEIDG and entrepreneurs registered in the National Court Register. In addition to companies, other non-governmental entities entered in the National Court Register, such as foundations and associations, must also have an electronic delivery address.
Representatives of certain public trust professions must also use electronic transmission. This applies to: – lawyer – legal adviser – tax adviser – restructuring adviser – patent representative – notary public.
The list of entities that have this obligation to have an electronic delivery box also includes:
– city and communal offices, – regional departments, – tax offices, – Social Insurance Institution (ZU), – Agricultural Social Insurance Fund (KRUS), – National Health Fund (NFZ), – public hospitals, clinics and health centers, – universities , schools, kindergartens, nurseries, – social welfare institutions, – ministries.
A longer period for the introduction of electronic transmission, including: courts and prosecutor's offices, law enforcement agencies, prison services and other units related to the implementation of justice. A new means of correspondence will be introduced in these institutions from October 1, 2029.
Deadlines for entrepreneurs
The term of E-Delivery implementation for companies depends on the date of registration of the company in CEIDG or KRS:
– companies that register their activity in the CEIDG or National Court Register from January 1, 2025, install electronic delivery boxes during registration – companies that registered or will register their activity in the CEIDG until December 31, 2024 must have an address. for electronic transmission from October 1, 2026 – companies that have registered or will register their business in the National Court Register before January 1, 2025 must have an address Electronic transmission from April 1, 2025.
Transition period
In November, the Sejm adopted an amendment to the Act that introduces a transition period in the Electronic Transfer Act until December 31, 2025. This change is intended for effective implementation of electronic transfer in government agencies.
During this period, transfers to the e-delivery address will be equal to transfers to ePUAP and other alternative delivery methods, and an extensive information campaign promoting the new delivery system will be carried out. The amendment also provides for the extension of the obligation to have an address for electronic transfers.
Ultimately, the e-Delivery service will replace official paper correspondence as well as correspondence via ePUAP.
Deputy Minister of Digital Affairs Dariusz Standerski, who was present at the session of the Sejm, reported that the government administration is ready to introduce electronic transfers. – The biggest problem at the moment is in local government units. In those local government units that recorded a decrease in income or a decrease in the dynamics of income and therefore did not have enough money to accelerate the development of computerization in their offices, he explained.
He added that from the beginning of 2025, the program for the implementation of the electronic transaction of documents in local government units (LGUs), financed from the KPO, will be launched. Standerski also announced that 2025 will be dedicated to ensuring that local governments, which are not yet ready, install electronic document transactions and introduce an electronic delivery system.
Account in electronic transfer system
Citizens, companies and institutions can use the address and electronic delivery box. Citizens submit an application through the website mObywatel.gov.pl. In turn, companies submit their applications through Biznes.gov.pl. Representatives of the public trust profession submit an application through the electronic service on the website gov.pl. Electronic transfer services are provided only by reliable service providers: government and commercial (non-government). The public e-delivery provider – currently Poczta Polska SA – is an entity that provides a free e-mail service and offers mailboxes to all those who decide to use the public e-delivery service. A non-public electronic transfer provider is a business entity from which you can set up an address and post office box for electronic transfers.
