It is not yet clear what will happen to the subsidy for law and justice. All members of the National Electoral Commission are working on a response to the Minister of Finance, who requested an interpretation of the recent resolution. It is clear from now that the answers will be unanimous.
The members of the National Election Commission themselves admit that it has been going on for too long. – I am not a supporter of the Brazilian series, but the issue of subsidies for PiS will take some time – admitted Pavel Gieras, a member of the National Electoral Commission.

There is no solution in sight. – The atmosphere in the National Election Commission, to put it mildly, is average. Tomasz Żółciak, journalist of money.pl, said that things are not progressing at the moment.
After the decision of the National Election Commission in December, which everyone understood in their own way, the finance minister wanted to clarify this issue. The head of the Commission answered, but the minister wants an answer from the entire National Election Commission. A meeting was held on this matter, but no decision was reached.
– I made such an application that the entire National Electoral Commission should respond to it, – said the member of the National Electoral Commission Rizard Kalish.
As money.pl reporters found out, both those who believe that PiS cannot be paid and those who believe that PiS should receive money should have their own draft answers. The National Electoral Commission should review these plans only on January 27.
– It will be very difficult to decide which of them will sit at the table of the Minister of Finance, and the question is whether the National Electoral Commission will not move from one clinch to another, – noted Tomasz Zolciak.

A case for court?
On TVN24, Pavel Gieras, one of the members of the committee, said that the National Electoral Commission will publish a detailed explanation on the basis of the December resolution. Does the phrase appear: to pay or not to pay? Maybe not.
– The National Electoral Commission cannot have such a strong position, because the court will not decide this issue – said Pavel Gieras.
The National Electoral Commission is not a court, and as we hear, it cannot determine whether the Chamber of Public Works and the extraordinary control of the Supreme Court, which ordered PiS to pay the money, is a court or not? The Minister of Finance is also not a court. We are back to square one. That is why the member of the National Election Commission raises opinions.
– It would be good if the court explained about this very complex legal situation – said Pavel Gieras.
Maybe the Minister of Finance will decide to refuse the payment, then PiS can apply to the administrative court and wait for the court’s decision. Or perhaps it would be better to place the funds intended for PiS in a court deposit and wait to see if the court will allow PiS to pay the funds or not.
– All this actually happens somewhere outside the Electoral Code, outside the procedures provided for there, and since there is no procedure, everyone gets lost somewhere. Whether any decision is made by the members of the National Electoral Commission individually or by the Minister of Finance, everyone is legally, even criminally, responsible for their decision. This is the reason for this closure, – noted Tomasz Żółciak.

PiS is already threatening the finance minister with consequences. – Every day of delay, every day that Minister Domansky decides not to transfer these funds, makes him criminally responsible, – explained Mateusz Kurzeevsky, the deputy spokesman for law and justice.
The former rulers consider all the chaos today to be their fault. – The coalition of December 13 brought more destruction to the Polish justice system than the communists after the war, said the law and justice deputy Marek Suski.
The Civil Coalition responds that the source of the problem lies elsewhere. – PiS was a specialist in the organization of the state – said Jacek Karnowski, a representative of the Civil Alliance.
– Who is responsible for this chaos? Who created this chamber in the Supreme Court that should never have been created? – Warsaw Mayor Rafal Trzaskowski asked rhetorically.
Prof. Zoll: there is no decision to force the finance minister to pay the money
The Chamber of Public Works and Extraordinary Control consists only of judges appointed with the participation of the new Council of the National Court, which has been politicized by PiS. The European tribunals question the Chamber, which has to decide on many electoral issues. Therefore, a number of lawyers treat her decisions as if they did not exist.
– There is no decision to oblige the Minister of Finance to pay money, – said prof. Andrzej Zoll, former president of the Constitutional Court and former chairman of the National Electoral Commission.

PiS believes that the non-payment of funds on the eve of the presidential campaign is an element of an unfair electoral game.
– This destroys the opposition, deprives them of funds and equality in the presidential elections, because the fact is that the opposition does not have funds to conduct a pre-election campaign, – said Marek Suski. – If (candidate – editor’s note) is a citizen, perhaps these citizens should help him to finance this campaign, – explained Kamil Vnuk, deputy from Poland 2050-Third Way.
– They are not entitled to this money, because they have already paid this money from the state money during the campaign, including Mr. Ziob for advertising and election places and other politicians, – said Dariusz Jonski, a representative of the Civil Alliance.

Opinions are divided on the left side of the political scene. – I think it is very unfair for PiS to receive money after what it did in that election campaign, but in this situation it is legal, due to the decision made by the National Election Commission, – said co-chairman Razem. – The National Election Commission should ask itself whether in the future it is in favor of the nomination of candidates to the Diet, who, for example, are ministers or deputy ministers in the Ministry of Health, spend the money of the Ministry of Health for their campaign? Will it be allowed or not – because this is the whole point of this question – said Deputy Minister of Health, Deputy of the Polish Socialist Party Wojciech Konechny.
All of this confusion currently concerns the issue of refunds for the last parliamentary campaign. There will be another element on Tuesday, as the Chamber of Public Works and Emergency Control will consider PiS’s appeal against the rejection of the party’s 2023 financial report.
