It is important that in the key vote we decided on the immunity of Jarosław Kaczyński for actions against a citizen, at least in this matter we obtained a sufficient majority to take away his immunity – said Prime Minister Donald Tusk after the vote on Friday. in the Seimas on giving consent for criminal prosecution of the president.
On Friday, the Sejm agreed to waive the immunity of Law and Justice President Jarosław Kaczynski in connection with the beating of activist Zbigniew Komosa during the monthly Smolensk celebrations. But the Sejm did not agree to waive the immunity of Kaczynski (as well as Anita Czerwinska and Marek Suski) in connection with the destruction of the wreath on the anniversary of the month.
Prime Minister Donald Tusk, who was asked by journalists immediately after the vote in the Sejm whether the coalition partners failed, replied that he expects such voting results because “he knows the opinion and mood of individual groups and MPs”. – It is important that in the key vote that we decided on the immunity of Kaczynski for acts against the citizen, that at least in this matter we won the majority to cancel his immunity and the politician to answer before the justice. “It has been simplified for ordinary people,” said the head of the government.
– Some are stricter, some less, but I am not complaining, – added the prime minister.
Asked if the vote would affect the ruling coalition, the prime minister denied it, saying: “I would expect that as we get closer to the next election, the thing about elections is that they tend to be more emotional and sometimes they should also disclose conflicts of interest.
Two cases, different decisions of the Sejm
The charge of the attack on Kaczynski by the activist Zbigniew Komosa is related to the incident that occurred on October 10, 2024, during the celebration of the one-month anniversary of Smolensk, during a fight in front of the monument to the victims of the Smolensk tragedy in the square of the capital. Pilsudski – according to Komosa – Kaczynski punched him twice in the face. Therefore, this activist filed an indictment against the president of the Republic of Law and Justice.
The second case concerns the request of the Police Chief to waive the immunity of Jarosław Kaczynski, Anita Czerwinska and Marek Suski. This is about the destruction by PiS deputies of the wreath that Komos had placed in Warsaw during the commemoration of the Smolensk disaster. In addition to destroying it, the deputies Chervinska and Suski were responsible for the theft of the plaque that was written on the wreath.
The inscription reads: “In memory of the 95 victims of Lech Kaczynski, who disregarded all procedures and ordered the pilots to land in Smolensk in extremely difficult conditions. Rest in peace. Polish nation.” There were many attempts to remove the inscription from the wreath; MPs of PiS believe that he defames the memory of President Kaczynski.
