We are facing a very serious constitutional crisis, said Professor Andrzej Zoll, former president of the Constitutional Court, on TVN24, referring to the fact that the Chamber of Extraordinary Control and Public Affairs of the Supreme Court, which is not recognized, decides on the validity of the presidential election. He stated that by then a new law on this matter should be adopted. He added that if Andrzej Duda does not sign it, he may appear in the State Court in the future.

Professor Zoll: the law needs to be changed
Zoll was asked if the winner of the election has no right to be sworn in before the National Assembly and actually take office until the Supreme Court rules that the election is valid.
– First, the correctness of the election must be confirmed by the Supreme Court. Next, we have regulations on the president's oath. I would like to note that all this is due to the abuse or violation of the constitution by the previous government. We are facing a very serious constitutional crisis, he said. He stated that in these circumstances, a new law should be adopted on the activity of the Supreme Court.
– It should be recognized that the provisions giving this authority (to decide on the validity of the election – editor) should be changed to the Extraordinary Control Chamber. But this should be done according to the law. This will be a problem in the field, because we may have such a situation that the elected person will not be able to perform his duties, – he stressed.
Professor Zoll: The president is sabotaging his duties
The former chairman of the Constitutional Court also commented on the host of the program Piotr Kraska that President Andrzej Duda will certainly not sign such a project. – The position of the president, who does not sign the document to bring it into line with the constitution, is not only a violation of the constitution by the president, but also a situation that corresponds to the responsibility of the president before the State Court or in the law. the court generally based on the article of the Criminal Code – he said.

Professor Zoll said that “very important” is the decision of the National Electoral Commission, which “says that it cannot decide on the need to pay money to law and justice” and that this can only be done after solving the problems of the Chamber of Emergency Control.
