What does it mean that Julia Przylebska is resigning from her post? For careful observers, this is an obvious move, because in this way he gains influence in the selection of the new president of the Constitutional Court. His term expires on December 9 – what else is there to remember about him, apart from the fact that he was the social discovery of Jarosław Kaczyński?
– This step is obvious – says Silvia Gregorchik-Abram, lawyer of the “Free Courts” Foundation. According to lawyers, the recent decision of Yulia Przylebska to resign from the post of president a few days before the election of her successor has a specific purpose.
Julia Przylebska wants to install her husband in the presidency after he leaves the tribunal.
– If he were the president, he cannot influence who will be the next president of the Constitutional Court. Therefore, just before the end of her term of office, which ends on December 9, she decided to take such a step, – notes Sylvia Gregorczyk-Abram.
Many harmful decisions
This is just one of the many decisions made by Yulia Przylebska in the last 9 years, which, according to our interlocutors, has led to the politicization, paralysis and lowering of the authority of the institution in which they have been judging and working for years.
– Julia Przylebska led to the collapse of the Constitutional Court, which was previously unimaginable. It had a high reputation in Poland and abroad and became a political machine, explains Prof. Stanislav Biernat, former vice president of the Constitutional Court.
Julia Przelbska's position has been growing over the years, even as the list of charges against her Court, which she presides over, continues to grow.

In addition to taking illegal actions, these claims include participation in internal disputes, which in practice paralyzed the work of the tribunal, and politicization of it, which led to the adoption of decisions in favor of the PiS rulers.
The politicians of law and justice do not understand any responsibility for the collapse of the Constitutional Court on their part. – Of course, it would be better if such disputes did not arise in such an important body as the Constitutional Court, – admits the Deputy of LAW and Justice, Marek Ast.
– Many people point out that the speed of work should be better, but it comes from the aggressive attack that the Constitutional Court faced, – says Michal Vos, lawyer of law and justice.
The key to success is loyalty
Julia Przylebska's position, as PiS politicians unofficially tell us, is the result of a relationship built on loyalty to the party president, as expressed by the statement of Law and Justice President Jarosław Kaczynski: “My social discovery in recent years.”
– Kaczynski's policy was aimed at destroying the institution that controlled the rule of law over the actions of the legislative and executive authorities, – concludes the professor. Andrzej Zoll, former head of the Constitutional Court.
The Seimas did not appoint candidates to replace the dismissed judges TVN24
On December 3, the so-called double referees Mariusz Muszynski and Piotr Pszczolkowski will end their mandates. Both were elected by members of the judiciary and then sworn in overnight by President Andrzej Duda.
The new government coalition will not elect new judges to replace them until the tribunal is reformed.
– Every person from the group of independent experts who joins this shadow society will be identified with it, – explains Tomasz Trela, a left representative.
