I don't know what happened to the chairman of the National Election Commission, it is incomprehensible, – said Wojciech Hermelinski, the former chairman of the National Election Commission, on TVN24. Wojciech Hermelinski, a retired judge of the Constitutional Court and former head of the National Election Commission, explained this case on TVN24 TV channel “Facti po Factach” on Sunday.
He pointed to the actions of Judge Marciniak, as mentioned by Rizard Kalish, stating that it was “incomprehensible” to him. – This has never happened. Of course, in the regulations of the Central Committee, the possibility of this periodic system of making certain decisions is foreseen. But this was introduced so that, for example, in some small technical matters (…) judges do not come, because some of them live outside Warsaw, – he explained.
– But this did not affect fundamental issues, such as evaluation of reports, which is one of the main powers of the National Election Commission, – he added.
Germelinski: I do not understand the attitude of the chairman of the National Election Commission
Germelinsky was asked if he would be a member of the National Election Commission, would he participate in such a “periodic process of adopting a resolution” in such a situation or not? – I can participate only by rejecting it, without signing anything, of course, – he answered.
– I'm sorry, but I don't know what was going through the head of the chairman (Marchinyak – ed.). I can guess that the intention is that in this pre-Christmas chaos one member of the National Electoral Commission can wave and sign for peace and the other will not notice because there are supposedly nine draft resolutions. Hermelinsky continued his speech. He added that “this is not an acceptable regime.” “I really don't get it,” he admitted.
– I know judge Marciniak, he is a good judge, but going to such a situation and trying to introduce such a resolution through the kitchen door and to destroy the resolution that was legally adopted on Monday is really incomprehensible to me. This is unacceptable, the chairman of the National Election Commission should not behave like this – emphasized the guest of TVN24.
Germelinski: This neo-chamber is not a court
Hermelinsky was also asked if he feared a future conflict over the validity of next year's presidential election, as the Supreme Court's Extraordinary Control and Public Relations Chamber also has jurisdiction here. Asked what would happen if this House declared the election void, he replied: – Well, then there might be a problem, because I'm afraid there's a slight difference in the votes, and then it's argued that it's been said. . by a body that is not a court.
