On January 1, 2019, Germany's previous packaging regulation “Verpackungsverordnung” will be replaced by a new packaging law, Verpackungsgesetz 2019 (VerpackG). This leaves online store owners, especially in the German market, with many important questions regarding sales packaging, outer packaging, transport packaging, and even packaging materials. Additionally, terms such as “obligation to participate in the dual system”, “obligation to register” and the newly created “Centrale Emballage register” should be clarified.
The Central Packaging Registry is established to enforce the Packaging Act and assumes important tasks related to it. Among other things, it provides a platform for so-called “Integrity Declarations”. In addition, the Central Packaging Registration Authority also handles a number of additional requirements, such as registration obligations under Article 9 and data reporting obligations under Article 10 of the Packaging Act. The central authority itself has published a precise list of new product liability obligations and a roadmap for registration in a comprehensive how-to guide (in German and English).
The new packaging law applies for the first time to everyone who commercially distributes packaging for sale in Germany (so-called “producers”), both German manufacturers, importers, retailers with online stores, etc. .
