President Andrzej Duda has signed an amendment to the Labor Code that extends maternity leave for parents of premature babies and babies hospitalized after birth.
Amendments to the legal system introduce a new institution that, in addition to the existing maternity leave, leave with the conditions of maternity leave, paternity leave and child care leave – additional maternity leave.
Who is the new maternity leave for?
Parents of children born before the 28th week of pregnancy or with a birth weight of more than 1000 grams are granted additional leave in the amount of one week of additional maternity leave for each week of hospitalization. , up to a maximum of 15 weeks.
For parents of babies born before the 36th week of pregnancy or born at term but requiring hospitalization, one additional week of maternity leave for each week of hospitalization up to eight weeks. In case of birth of more than one child in one birth, the weight of the child with the lowest birth weight and the longest hospitalization period of the child are taken into account when determining the amount of additional pregnancy leave. .
Duration of the week
It is mentioned in the regulations that to determine the amount of additional pregnancy leave, the periods of the child's stay in the hospital until the 8th week or the 15th week after birth are collected, and a partial week is rounded up to a full week. This provision takes into account the intervals between subsequent hospitalizations of the child.
