On Tuesday, President of the Constitutional Court Bogdan Święszkowski sent the following letter: Invite the Prime Minister, the President of Seim and the Senate, and the leaders of the political parties to discuss the future of the Constitutional Court.
“We have already received one response from a representative of the judicial authority, and we are waiting for responses from representatives of the legislative and executive authorities,” Święczkowski said. He made it clear that it was the Supreme Court.
Asked why the president's name was not on the list of recipients, he replied: “When I was appointed president of the Constitutional Court, I told him that I would talk to him and try to reach a compromise.”
Grzegorz Kempka recalled the words of the President of the Constitutional Court, who said that the Prime Minister had committed a constitutional offense by not printing the judgment. – I'm just stating the facts. However, when it comes to the situation of one of Poland's most important constitutional institutions, namely the Constitutional Court, this is not a matter of discussion or compromise. I do not intend to reveal my negotiating tactics, but I would like to know the prime minister's real opinion, not the one expressed publicly. “I hope that this attempt at compromise, this openness on my part, will also lead to some reflection on the part of the legislative and executive authorities,” he added.
Święczkowski stressed that there is “no possibility” that the current members of the Constitutional Court will resign. – Currently, there are 12 judges on the court, and there are three vacant judge positions that should be filled, and judicial candidates should be selected by Seim. He explained that he thinks this is a compromise because two more judge positions will become vacant next year.
