The National Prosecutor's Office requested the Supreme Court to waive the immunity of judges Piotr Shab and Przemysław Radzik in the case of obstructing the judgment of Igor Tuleya. This refers to the period when Shab and Radzik worked as president and vice president of the Warsaw District Court.
– In the course of the ongoing trial, the internal affairs department of the Public Prosecutor's Office has collected all the evidence and to conclude this case, it is necessary to decide that Piotr Shab and Przemyslaw Radzik should be accused of committing a crime and committing an activity. with their participation, – said the press spokesperson of the Prosecutor General, Prosecutor Anna Adamiak, on Tuesday.

Judge Tuleya was removed from judicial work
Igor Tuleya, a judge of the Warsaw District Court, was removed from judicial work in November 2020 after his immunity was revoked by the Disciplinary Board of the Supreme Court. At the end of July 2021, Tuleya filed an application for reinstatement, citing the EU ruling. This judgment showed that the system of disciplinary accountability of judges in Poland does not comply with the laws of the European Union. But the judge did not return to work at that time.
As a result, Tuleya submitted a notification to the prosecutor's office about the possibility of increasing the powers of the temporary chairman and deputy chairman of the capital district court – Shab and Radzik. Later, Warsaw investigators refused to start investigating this case. Judge Tuleya's deputy, Michal Romanovsky, filed an appeal after this decision. The Białystok District Court considered this appeal and in November 2022 canceled the prosecutor's decision to refuse to start an investigation and ordered the case to be reviewed.
The OKO.press portal reported in March that the investigation of this case by the Department of Internal Affairs of the National Prosecutor's Office began on February 21.
